Limited Lifetime Warranty

The warranty of Opttico Office Gliders are limited to the terms set forth below:

What is Covered

Opttico warrants its Opttico Office Gliders product (the “Product”) against defects in materials and workmanship for the Product’s lifetime on the market (that is, for as long as Opttico makes this Product), or for as long the particular Product unit is kept by its original retail purchaser, whichever is longer (the “Warranty Period”). If a defect arises during the Warranty Period, Opttico (or its agent), at its option will (1) repair the Product at no charge, or (2) exchange the Product with the same or functionally similar product.

Exclusions

Opttico products purchased from unauthorized distributors or resellers are not covered by this limited warranty. This limited warranty does not cover the normal depletion of consumable parts such as polyurethane wheels, the outer finish, cosmetic appearance, or any commercial use of the product. This warranty does not apply to defects due directly or indirectly to misuse, abuse, negligence, accidents, repairs or alterations outside our facilities or the lack of maintenance, neglect, exposure to moisture (outside use), fire and other acts of nature. This limited warranty does not cover any damage, deterioration or malfunction resulting from the installation or removal of this product from any installation other than office furniture, any unauthorized tampering with this product, or any other cause which does not relate directly to a defect in materials and/or workmanship of this product. This limited warranty does not cover packaging or any other accessories bundled with this product for promotional purposes.

Who is Covered

Only the original purchaser of this product is covered under this limited warranty. This limited warranty is not transferable to subsequent purchasers or owners of this product. Proof of purchase is required to qualify for the warranty. To obtain this limited warranty you must register it within 30 days of your purchase by completing and submitting online warranty registration. Proof of purchase is required to qualify for the warranty. For all Product returns covered under this limited warranty, the purchaser is responsible for the charges of shipping the Product to Opttico (or its agent) and must use a method of shipping that provides a tracking number and proof of delivery. Opttico (or its agent) is not responsible for any package that it has not received. The purchaser will also pay shipping charges to return the repaired or replacement product to the purchaser if the repair or replacement is covered under this limited warranty.

Limitation of Liability

IN NO EVENT WILL THE LIABILITY OF OPTTICO OR ITS AGENTS OR ASSIGNS EXCEED THE REMEDIES EXPRESSLY SET FORTH IN THIS LIMITED WARRANTY. WITHOUT LIMITATION OF THE FOREGOING, OPTTICO AND ITS AGENTS AND ASSIGNS WILL NOT BE LIABLE FOR ANY PROPERTY DAMAGE, LOSS, PERSONAL INJURY OR DEATH AS A RESULT OF ACCIDENT OR MISUSE OF THE PRODUCT.

THIS LIMITED WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES OF QUALITY AND PERFORMANCE, WHETHER WRITTEN, ORAL, OR IMPLIED. ALL OTHER WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED. IN NO EVENT SHALL OPTTICO OR ITS AGENTS OR ASSIGNS BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, STATUTORY OR EXEMPLARY DAMAGES, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, LOSS TO PROPERTY OTHER THAN THIS PRODUCT, OR OTHER PROPERTY OR ECONOMIC LOSSES.

There may be some jurisdictions that do not permit the exclusion of incidental or consequential damages so that exclusion might not apply to you. This writing constitutes the entire agreement of the parties with respect to the subject matter hereof. No waiver or amendment shall be valid unless in writing signed by Opttico. If any term herein is held to be illegal or unenforceable, it shall be deemed severed from this limited warranty and the legality or enforceability of the remaining terms shall not be affected.
